Typical soft strike on obverse makes it difficult to decide degree of wear and or light strike, so I'd use degree of luster remaining as an indicator of EF-45.
Reverse nicely struck, also as typical, slightly less rub evident, slightly better luster remnant among tighter design elements. AU-50.
As a single grade I think it might still make the AU-50, but only barely.
If you have a choice, this isn't a Coin I'd choose because of the seriously detracting bag marks, especially on Obverse, particularly on cheek.
1861 is relatively common in EF-40 to AU-55. I'd find one with a few less marks, especially marks in high importance areas.
