I agree with Fourmack, neither appear to be high 9.

However what you might be noticing is that the 9 on one of your pennies appears to be a bit higher than the other, sometimes referred to as medium 9 and still common within the standard low type. The 9s of the 1929 cents are not solely of only two types - high or low.
