That cent were confiscated by the US government before going to Heritage auction, if my memory serve me correctly.

Wow! As of 2014 the estimated population is 12 to 14. It is technically not illegal to posses or sell the coin but if the U.S. Mint shows up and asks for it back it would be illegal to not hand it over; it is U.S. Mint property and must be returned on demand. A congressman tried to sell one at public auction in 2014 and the U.S. mint intervened and the coin was returned. Albert Toven, a capital police officer saw a congressman drop a 1974 Aluminum cent at a capital building and tried to return it to the, unnamed, congressman who thought it was a dime and said Toven could keep it. Toven had it graded. The initial grading was AU-58 but PGCS regraded it as MS-62. Then in May 2020 A picture of the Toven coin was posted in a thread on CCF and the rest is history.
I just saved everyone a trip to Wikipedia and looking up some of the references. Moral of the story - Do not take wooden nickels or aluminum pennies.

No 1974 philadelphia coin has ever attempted to go to auction and the government, although laying claim to it as being government property, has never actually tried to recover the Toven coin. Quote:

The 1974 D that was being put up for auction was not owned by a Congressman, it was the son of the man who was head of the Denver Mint in 1974 (They used to call them Superintendents, I believe they have a different title now.) The one in the Smithsonian did come from a Congressman in a way. Congressman was retiring and an aide found the coin in his desk while cleaning it out and sent it to the Smithsonian. Of the 10 or 12 that were not returned to the Mint after they were shown to the committee, only the Smithsonian and Toven pieces are known. |
