Looks like an early die state N-9 to me. Pictures are not the greatest but I think it looks XF 40 or so sharpness to me. I think the white flecks should come off with some acetone and verdicare. $45 plus shipping is more than I usually spend on these types of coins but in XF this variety gets pricey. Maybe you can provide better photos when you receive the coin.
Hard to tell anything from those, especially with it being encased.

wow, thats some pathetic photos to grade from. the reverse appears to have quite a bit of verdigris floating around. it might make XF40 but may not grade straight

I can hardly see the date in the new photos!
