Hard to tell if the surfaces are original.
If so then AU53.

There's a little wear on the shoulder bow, the crown, leaf tips and areas of the face enough to show. It looks cleaned at some time passed. I'd say XF-45 or AU-50 on a good day.

The reverse is very nice - very little wear and in general - that could go higher than EF-40. There's some pretty clear wear on the obverse though - moustache, cheek, eyebrow and the high points on the crown. On balance, the highest I could see this going is AU-50 assuming the surfaces have some mint frost [which is notoriously difficult to tell from photos!] but my initial instinct was EF-40 as well. Either way, it's a very nice coin...
