I have emailed Mr.Moy and this was his response:

Thanks for your e-mail concerning the "America's Beautiful National Parks Quarter Dollar Coin Act of 2008" (Public Law 110-456). This legislation has been signed into law and specifically authorizes new reverse designs for quarter-dollar coins beginning in 2010 to honor our national parks or other national sites.

Your suggestion to feature an image of Theodore Roosevelt on the obverse of these coins was shared also by Representative Peter King of New York who, in remarks on the House floor on July 9, 2008, stated that "the front of this new coin should bear the image of Teddy Roosevelt." Accordingly, Congress has had the opportunity to consider this idea.

While the Secretary of the Treasury does have authority to change an obverse or reverse of a circulalting coin that has not been changed for 25 years or more, like the George Washington obverse of the quarter dollar coin, our past practice has generally been to defer to the United States Congress on new designs for our Nation's circulating coinage.

I do appreciate you sharing your thoughts with me on this issue.

It means they are passing the buck!

In other words, the Mint does not have the courage to do something about it. Either that or they are just too lazy to care.

Director Moy is basically saying that Congress "messed up" by choosing to retain a slightly modified Washington obverse and since the design has not been around for 25 years(the amount of time a design has to be used for the Mint to be able to unilaterally change it without Congressional approval), the US Mint and the Treasury Sec's hands are tied in regards to the design.

He is saying that yes the Sec has the authority, but he isn't going to take the political risk of making such a decision on his own but will instead wait for Congress to make any design changes.

In the latest Coin World(Oct. 5) there's an article about the mint is going to make a 5 oz. version of these to be sold at these parks, available to the parks in 1,000 unit increments. It will also be available to the ASE bullion network. Also in the last week of Dec. the mint will start making 2010 ASE bullion coins so the bullion dealers can get them after Jan. 1. Now if the mint can get enough silver to do this, then why don't we have the Proof and W unc. ASE coins for this year yet? The UHR gold coins have held up production of the gold Buffalo also. The Treasury Secretary needs to clean house at the mint and Director Moy needs to be handed his walking papers!

I really do wish they would use the silver to make the W ASE just so I can keep getting the Annual Uncirculated Dollar set that I started collecting the first year they started making them. Its a really nice looking set to see all the different Dollar coins together like they are in this set and even though they may not be a numismatic hit I would still like to have one from this year. I also always buy a W ASE by itself each year also so now I have 2 sets that include the same coin that may come to a end that I was hoping to have a nice complete set of and more than just a few years worth
