Let me just pull out the latest Charlton guide... (come on, we're all excited to use it on the silver 5 cent coins. Admit it)
It looks like a small 5 to me as well, And I don't see any varieties on there other then that.

looks like either one of the following, according to Carlton:
Narrow date
repunched 1/1
first 8 punched 8/8/3
second 8 wide oval 8 / wide 8
large 5/ large 5

OR
narrow date
small 5/small 5

However, it appears , without getting a macro shot, that the whole date is manipulated.

Yep, this is a Small (Top) 5. But there are two varieties of the Small (Top) 5. This one is the Tall Small 5. It seems a bit harder to find than the regular Small 5. Note that the Tall Small 5 is noticeably bigger than the Large (Top) 5. So this variety can be a bit confusing to some collectors when they just look at the size of the digit. The original description (from decades ago?) differentiated the two varieties with the full description Small Top or Large Top. But somewhere along the line the Top got dropped.

Not to be stubborn, or arbitrary, but the "5' is larger than any of the other digits, in the date, just looking at it.(then I read MKB's post, and looked at the top one, LOL).
looking at the two "5's", the top one seems to have a shorter, (smaller) flag.
Looking at the 2010 Varieties book, it shows the two 5's, and also the 5/5, large over small. All three occured during the year. The difference lise in the space between the flag, and the lower part of of the 5.
Hope this helps.
Dick
