I am split on this one. I don't know if the flattened areas represent wear or weak strike, because the top of the cap (where there usually is wear) lacks wear. So either a weakly struck AU-50, or EF-45

I will say EF-45, the buckle doesn't have enough detail to make AU in my opinion

This is kind of an interesting coin.
The clasp seems to be of a weak strike along with some of the stars on the obverse (since the capped hat details look great) and on the E PLURIBUS UNUM on the reverse, but the wing wear and top of the eagle head seems to me to be circulation wear along with some of the hair curls and forehead.
The obverse five o'clock and eleven o'clock depressions (dentil deformations)on the obverse and one o'clock and seven o'clock depressions on the reverse seem to be strike problems since they are symmetrical on both sides, of both sides (confusing I know...).
So, with a couple of reverse minor rim dings, I would go with VF-35, personally.
Still working on the Overton.
Like I said before, I like it! And the hint of toning on both sides ices the cake!

With the amount of wear, I would have tyo agree with Shadow it is hard to tell is it wear or weak strike. EF-45 If it is weak strike AU-50

I always try and look at a coin again, When I magnify the pic. Yes I would say EF-40 and maybe evan VF-35. But I'm deffinatly no expert.

Nice coin, the wear above the eye will keep it from going AU. If not for that the rest of the detail would have easily made it an AU-50. I'd grade this coin at EF-45.
