Variety is O-106. Those are all die cracks, not scratches.

The details are weak, but my guess is that it is a weakly struck LDS choice AU. Some crazy die cracks, and it looks like some kind of split going down the bust. Though overall, it looks more like a 40 as far as detail is concerned, there are some high points that have little to no wear, such as the hair above the eye. Very interesting coin.

This coin is a beauty, I've been trying to get a nice 1812 for my collection, but have been out bidding on two just yesterday. This is one of the most interesting varieties for this day. The dies were just about gone on this one. A weak strike at least EF-45. But I wouldn't be surprised if it slabbed higher.

Many classic coins present a grading challenge in that strike weakness looks a lot like wear. In this case I agree with most posters: this looks like an XF-45 to AU-50 coin. The hair curl to the right of the eye and the eagle neck feathers are fully detailed and show almost no wear. If the coin had seen more than brief circulation these high points would be among the first to wear down. Lack of detail everywhere else is almost certainly strike-related.

The shattered die probably contributed to the striking problems. With that much damage to the die faces it's not surprising that the striking process didn't go well.
