I just read in CoinWorld that PCGS has initiated a lawsuit in Federal court accusing Burnsville Coin Company (dealer Barry Skog) for selling counterfeit PCGS PCGS holders that were made to order from Chinese manufacturers. The lawsuit was filed on December 7th in District Court of California, the complaint alleges violations of the Hobby protection Act, the Lanham Act, Violation of RICO, Common law fraud, conspiracy and violation of California's unfair competition law. They say this dealer was buying direct from the manufacturer of the fake coins and slabs and asked for specific denominations and dates of coins after receiving orders from their customers. The filing cites one example where Robert Webber of Goldsboro NC purchased two coins from the defendants in April 2010 for 12,400. The coins were Seated Liberty dollars dated 1851 and 1858

I totally agree with the sentiments, but he has not been found guilty yet. I just hope his business suffers IF he is found guilty.
What really needs to be done is to get to the originators of the fake material being produced.

This post is a warning shot over the bow of these dealers that sell counterfeit coins as real. They well never read these posts, since the bottom line is all they read..
I just hope there is a paper trail to China from his store, instead of an off the street sale of these coins to him. I read posts on the certified coin exchange : beware, we where offered a rare coin today and we did not buy it it was counterfeit and here is the description of the seller and coin. This alerts all coin dealers in that area even if they are not on CCE they are called by the member dealers. sort of an APB of coin shops.
Canada has banned there import. The US has not

Lawsuit? The guy should be in jail if he's guilty. Kudos to PCGS for doing their part.

Deciding whether a person should go to jail is very subjective. Being a businessman, they should just go on with a lawsuit and hurt him in his pocketbook. No need to throw him into "criminal university" where he'll be exposed to shadier stuff and come out smarter.

In CW it just mentioned some John Doe's that may be brought up at a later date Quote: Deciding whether a person should go to jail is very subjective Yeah as much as I am against this, PCGS is in no position to be placing anyone in jail but it could definitely hurt PCGS's reputation as a business if no one will buy their slabs sight unseen because of people doing these things. And if I remember that was the main purpose for a TPG so people could buy sight unseen. If PCGS wins their case and then DA wants to use their evidence to bring charges against them for their unlawful selling counterfeit coins then that may happen but PCGS needs to take action like this to let everyone know (not only the dealers but the customers as well)that they aren't just sitting idle and letting these people do this and them do nothing

Wow! You know, I expect to be on my guard when shopping on ebay, but when the brick and mortar dealer is in on the act -- Yikes!

I just read the PDF closer and it seems this is pertaining to the coin doctor law suit instead of the one I was talking about at first. This is a second law suit PCGS has brought against people that are doctoring coins and sending them to PCGS. So they are going against these people knowingly selling counterfeit PCGS graded counterfeit coins to their customers and other dealers that are doctoring coins trying to deceive PCGS to get higher grades which is against the PCGS Dealer Agreement that the dealer has to abide by when submitting coins to be graded. Just the coins listed that they have bought back is about $140,000.00 worth of coins they have bought back because they were doctored

Interpretation of law can be subjective at times, but I'm pretty sure knowingly buying and selling fraudulent items is a clear cut crime. Either way from a moral standpoint it is theft, plain and simple. People who buy and sell fakes misrepresenting them to be real are crooks and should be treated as such. Put him in a 6 x 5 cell and let him spend 23 hours a day there with a scumbag roommate who doesn't wear a white collar and that would be fine by me. He's no different than some predatory purse snatcher. I agree that our judicial system should focus more on rehabilitation, but that's a separate matter. And Bryan, I agree that PCGS isn't in a position to put anyone in jail. They're not the District Attorney's office, nor are they law enforcement. As a business they are doing what they can and suing, which is why I gave them kudos. I hope in the back scenes they're also contacting local and federal authorities and talking to them about going after these crooks.

I am sure the DA is watching this case very closely and even if by chance PCGS doesn't win I believe they may still take the evidence PCGS already has and file a claim against them also. So in other words I am willing to bet their legal troubles will not end with this PCGS case. The coin doctors mentioned in the pdf above is a different story, and if PCGS can actually prove they did it to deceive them and to extort money from their company then they will lose their case and I do not believe the DA would get involved since its not actually against any laws that I know of like it is with counterfeit US coins
