I'm pretty certain that for items less than $250 in value, a proof of delivery confirmation (to the buyer's paypal-listed address) protects against claims of "not received".

I am confused. What exactly is the buyer complaining about. Did he receive item? Or is he not satisfied with item? I have been buying and selling on ebay for years. Every time I have been involved with dispute a fair and proper resolution has accrued usually with out the help of ebay. When a buyer or seller ignores emails ebay usually does not take their side. The ebay dispute mechanism does work. Good Luck.

soccerdad...he is saying item not received...I was a little confused on the issue too. But I think as others have said that the OP should come out ok on this one. I hope the buyer can't change his feedback.Do all communications through the ebay message system to CYA.

Thought I'd get some more opinions if I could before responding to this guy. Any suggestions on how I should respond? I'm sure he's frustrated. Might even have a crooked postman... I'm thinking of suggesting he take it up with his local post office.

Sometimes as disputes start time passes then items do arrive. Then everything is ok. Recently I bought an item and after 45 days still no show. Sent an email to seller. Then it arrived the next day.

I would visit my post office and ask them what to do..let him know you are investigating.Like soccerdad, I had an item take almost a month to arrive,but if your confirmation shows that it was delivered,let the post office tell you what to do and he can deal with them if he doesn't like the answer.

The buyer's issue is with the Post Office, not you. As far as PayPal will be concerned, once the Delivery Confirmation number shows "delivered", you're off the hook. You have no control over what happens to the package once it's been delivered. I went through a very similar circumstance with a $600 coin. My buyer lived in an apartment complex. The Post Office delivers mail to the complex and then the doorman delivers the mail to the individual boxes. My package was delivered and signed for. Buyer didn't get his $600 coin. Buyer filed an INR dispute through PayPal which froze the funds. I provided proof of delivery with a signature. Ultimately, I won the PayPal dispute and got the money back. I would go to your Post Office and inquire about the package first. They should be able to give you their printout of the history on the package. I can't remember if it shows what address it was delivered to or not, but it might. I would then suggest that the buyer do the following: 1) Give the buyer a description of the package, especially if it is packaged in something that might stick out. Perhaps a family member received the package, forgot about it, and it got set somewhere (buried under the clutter on the kitchen table for example). This has worked several times in the past for me. 2) Check with neighbors - maybe it got delivered by accident to a neighbor, or maybe a neighbor saw the package on the doorstep and they took it for safekeeping. 3) File a complaint with the Postal Inspector. It sounds like this isn't the first time he hasn't received packages even after they've been scanned as "delivered". There is either a problem with a careless postal employee, or there is a thief at work (either an employee or a neighbor). Either way, neither of those problems are yours since you have proof the package was "delivered". They will be able to advise you on how to proceed and what, if anything, you need to do.

To everyone that ships. Iship everything with a tracking number for a extra 80cents..... BUT Do I need to get a sig conformation also to be paypal protected?

I just opened an ebay dispute with a seller for non-receipt. He does have delivery confirmation provided by USPS. What I have is a torn, empty envelope inside a USPS "delivery exception" clear plastic envelope. The seller shipped the coin in a non-padded manila envelope with the coin taped to a flimsy piece of cardboard. Based on the folds in the envelope and the telltale rub marks it appears the coin was ejected when it went through the cancelling machine. I contacted the seller immediately and informed him of the problem. He was apologetic and agreed to refund my money immediately. Two days later and no refund I contacted him again and he restated his "I'll get to it immediately" response and asked for my personal email. Two more days and no refund, the dispute was opened. I went through all this here to demonstrate that "absolutes" don't exist in the ebay claims arena. The seller does have delivery confirmation, but he will still end up refunding my money.

Seated, Will you get the refund due to it being granted by the seller, or compelled by eBay/Paypal policy? Think the outcome would be different if you didn't have the envelope? Just curious. Thanks.
And I've had non-tracked items take 60 days to arrive. Who knows where the package was for most of that time? The buyer sounds reasonable in his email, but you'd think after problem #2 he'd get a PO Box. Anyway, good advice from cwb. Good luck.

If there is then yes you may get your money back, if there isn't I am not so sure since he can say I did what I was supposed to do and I have proof it was delivered and this guy is trying to scam me. I have proof it arrived but he has no proof he didn't get it kind of deal

Unfortunately, just because the DC says delivered, doesn't mean it is. Carriers in some rural areas do not have scanners. Heck, some of them aren't even postal employees. In these cases, all the mail that goes on the truck is scanned delivered at the PO before it leaves. From there their are oodles of ways it could not end up in your mailbox.

The barcode was scanned through the "exception" envelope. I visited the Post Office immediately after delivery and asked them why they would go ahead and confirm delivery of an empty envelope. The supervisor said that they recognized the original envelope was damaged and highly likely that the contents were gone, but since they had no knowledge of what the contents were, they sealed it in their clear plastic envelope and processed it normally. I have the unopened original mailing envelope sealed inside the clear plastic USPS delivery exception envelope that is postmarked on the delivery date. Everything is as it was when I pulled it from my mailbox.
What the seller has is a delivery confirmation of an empty envelope. Had USPS not sealed it in their own container I would probably be out there hanging ... which has happened to me before.

I wonder if a Not As Described claim could be successfully argued in this circumstance? An empty envelope is not what was described in the auction. I dunno, just a thought... Thankfully (knocking on wood), this hasn't happened to me. I think I'd have to call PayPal to see how they would want me to proceed under these circumstances.
