Misrepresentation is a tort, or a civil wrong.

We call this fraud. Sometimes its difficult to prove. Other times, like this one, its a slam dunk. I would love to have a case this simple. I would win this one on Preliminary Objections. It would never get past the pleadings stage.

So with the info you have available right now you can slam dunk prove that this seller knows for sure this coin is not an error coin?

Sorry guys but one of my biggest pet peeves in the forum world is people that throw around the "f" word that quite obviously don't know what it means.

It's just frustrating to have yn's get discouraged after finding out that their "error" coin that they spent good money on is PMD and only worth face value.

It's even more frustrating to answer a query regarding a coin, telling the poster that it's PMD and they still go ahead and sell it as an error for a substantial amount of money to someone who just wants to add to or start a coin collection. When the buyer finds out they were taken for a ride, that would sure put a damper on their collecting spirit.
