I would guess EF35. I think the ear has too much wear to be EF40, and the eagles breast is pretty worn looking. But, that's based on looking at other pictures of similar coins. I love this part of the forum! You get so much practice looking at coins and learning what to look for. Hope it's higher than a 35, though.
