What would you grade this coin? How much does the rim at 12 o'clock factor against the coin over all?

Tough to say without reverse photos. AU possibly Unc but need the reverse. Is the 12 o'clock environmental damage or lamination problem?

its actually a rim Cud. so its not damage.

and the grade looks to be about AU-55 (judging only by the obverse)

I'm thinking AU/50 also but there does look like some corrosion has taken place on the OBV, interesting to note the 1 almost touches the neck! perhaps theres some error guys might have an idea of what variety this one could be?
