I would guess 38, because the middle section of that digit appears to be near middle of the bottom loop. If it was a 5, I think it would be more full width.

EDIT - Also, the bottom loop of the 5 that year was less curved

1938. The bottom of a five is less curved than what's shown on this coin.

Even more telling is the number 8, which is much wider on a 1958.

This is unquestionably a 1938-D

The overall condition is more like what you would expect with a 1938 than a 1958.

The upper loop of the 8 in 1938 is much smaller than the lower loop. The upper and lower loops of the 8 are the same size in 1948, 1958, 1968, etc. By the way I collect all 1938s because of this unique characteristics. Yours is 1938d.
