Because of the wear on the eagles breast, wings and talons. I'm going to say EF-40. Though there is enough detail on the obverse t bump it to EF-45.

If I submitted that and it came back as EF-40 I'd be upset. That coin is as good or better than coins sitting in AU-53 holders, including an my AU-53 coin.

Maybe I'm misreading the photo.
