I found and old post from this site with this picture, the responses seem to conclude the the mint mark was damaged but I have found another one with an identical mint mark. Does this make it a true error coin?

Metal Money

This is not an error coin. It is a damaged coin. Whatever happened to the MM, happened after the coin left the mint.

Like I said in my post, this is not my coin but the coin I have has an identical mint mark. That would mean two coins were damaged in exactly the same way.

That is not as unusual as you might think. I find many coins with a contact marks in the exact same place. That doesn't change the fact that the coins are damaged.

Late 1970s D mintmarks are almost always mushy and indistinct.
