What comes to mind here is the quote from the old TV series "The X Files" --- "Trust no one."
You obviously caught them with their pants down around their ankles. At the absolute least, they're in clear violation of the so-called "stock photo rule" (if that's all), so they're quite humiliated by getting caught in the act. What they've done is beyond argument, their purported integrity has taken a solid hit and the sea water is rushing in through the hole in their hull. They presently need some serious high-speed damage control and they're highly motivated to do or say whatever it takes to save face here. I believe right now they'd say or do literally anything to get this altogether too-public embarrassment to go away.
In fact, I'm confident they'd even quote the late Richard Milhous Nixon, who when under extreme duress once said "I'm not a crook."
Integrity is kind of like virginity - once you throw yours away, it's kind of difficult to get it back.
If I was in your position, I wouldn't be putting any stock in anything they said to me right now.

Quote: Thanks for reporting these listings to us.
I reviewed these listings and confirmed that they violated our Selling Currency policy. As a result, I sent your report to the seller's account manager for action.

Hayden here from ModernCoinMart, I spoke to you yesterday on the phone. I appreciate what you've pointed out and I apologize for any confusion we caused you. We will take a look at re-wording our stock photo language to be more concise. I would also like to point that all images we take, even after the coin is sold, remain the property of ModernCoinMart. Thank you, Hayden MCM ebay Team Manager

Rewording? I'm curious why you even think you're allowed stock photos in the first place. I'm not, why should you be? Plain as day in the coin selling rules.

I've been reading and learning here for a long time, but I had to register to post in this topic. Moderncoinmart, I don't understand why you think you can use stock photos anyway. Everyone knows that we are supposed to "buy the coin, not the slab." This is not possible if you are using stock photos. There is a reason why stock pictures are not permitted in the Coins category. Why should the rules be different for you?

"Rewording" = DAMAGE CONTROL = SAVING FACE. You're caught and you have no excuse.

I'm going to go ahead and ask you all to take a deep breath while contemplating the term "perspective."

Hayden, you're using a stock photo in a deceitful manner and in direct violation of ebay rules. Your claim "the coin you see is the coin you get" is disingenuous. And, regarding you crying about the image and copyright, posting it here is a fair use. But, you knew that.

That said MCM would have been better off with a simple apology. Theres not really anything to save face with and I dont think anyone would stop doing business with them just because of that. But if they look bad from defending it some people may be turned off by that.

It is misleading and IMHO, unethical to use stock photos of any coin you are selling. You should be looking at the coin you are contemplating being purchased.

Here's my problem. If I were to use the same stock photo on 30+ different listings, multiple times over, I would get no warnings. I'd just log on one time and they'd all be gone. I report these and they get "an email to the account manager." Now Hayden just read that, and likely got "the email" since he's here now. But here's what he says... "We will take a look at re-wording our stock photo language to be more concise." ... He's basically thumbing his nose at all of us saying I'm not going to stop doing it, just make it more clear. Off to find Laura Sperber's email address. Maybe I'll send her this link too.

Well said Scubu. I've actually had listings removed because they were the same thing when I had two of the same commemorative and used different photos but wasnt allowed to sell them at the same time unless I did it with the multiple available option. I get they sell more and will get special treatment but a simple I'm sorry would have gone a long way. Stock photo or not, at the very least if the coin pictured is sold and the new owner asks you not to use that picture anymore that picture should be removed
