I would try to contact him first through ebay. If that does not work, file a claim through ebay. If you do it on their site they can track it and help you resolve the issue. I sell a lot on ebay and hate when people do transactions like that. I they don't get reported, they will continue to do it if he was trying to scam you.

Okay Ray, it's kind of hard to prove this and explain it but trust me I know I'm right.
Front 1. If you look at the photo you see white dots on the coin. 2. The coin has black on it. 3. The coin is fuzzy a little.
Back 4. Different color background, plastic, and coin. 5. Some white dots and fuzzy. (same as three)
Answers 1. White dots can happen from bad pictures and bad editing skills. ( such as, changing color, resizing. 2. This can happen from changing lightness on coin. 3. This happens from resizing. Or if you change the contact this also causes fuzz. 4. Now this one is tricky, he could have changed the lighting. And that's what he did. But he also changed the color of the coin lightly.
I understand changing the size is not really editing. But changing the color and light is. ( I mean light of the photo, not the light shining down on it.)

I think you should consider yourself to be lucky that you have your money back. Like the majority of purported 1970-S Small Dates on ebay, the chances that the coin was actually a Large Date is quite high because it seems like most people on ebay have no clue how to recognize a SD. The tiny scans do not instill confidence in the seller either  Do not purchase a SD on ebay unless the seller provides pics large enough and clear enough to definitively identify the coin as a SD.

Just my opinion ... but I agree with Ray, I think it is a small date, mostly from the mushy "Liberty", although I would like to see a close up of the date.
As for the white dots .. I am thinking they could be on the Ait-tite. For the color difference, when I take pictures .. I don't know how to set the white balance on my camera, so when I re size in picasa3, I do a auto correction. That seems to bring the coin back to the actual color. IMO - seller did a auto correction on the reverse .. but forgot to do it on the obverse.
Of course if the photo experts .. say different .. I would go with them.
As for the coin .. I think you would have made a good deal at that price.

Yeah it would've been a killer deal if I had gotten the coin. I've been watching small dates for awhile.

HAHAHAHA...classic ebay. Like Bio said, most of the "small dates" I've seen on ebay are actually large dates. If you're interested in one in MS red, shoot me a PM. I have almost a whole roll of them.

I'm thinking MS63-64 to be around 20 to 25 bucks but I'm not sure if that's up to date prices.

About a year ago, I went on a quest for a 1970S Small Date. I did all my homework, printed large copies of the examples and quit 6 months later. I found it nearly impossible, even with very good magnification equipment to detect variation. I even discovered that many experts argue the point. I reached the conclusion that if it was so hard to tell this type of variation from the standard coin, it just wasn't worth the trouble and doubt...

I actually think the 1970-S is one of the easier variations to distinguish using only a loupe and eyeballs. Then again, I've been told I am not like most people.
