First one looks like it lacks luster, second one looks like it was dipped but not cleaned (there is a HUGE difference!).
If I had to pick, i'd go with the later.

Do you see that scratch or something going through the "A" in "STATES"? And it continues with three distinct marks under the "ST". Would that be enough to warrant a damage grade?

Hm... Maybe its a planchet flaw? I dont see any raised metal that would indicate it was a deep cut.

The second coin seems to have stronger luster in spite of the possible dipping. Details are also considerably sharper and the CAC sticker is a plus. It does look like there is a hit on A of STATES but even so I think #2 is a better coin.

I like the second coin better due to nicer luster and sharpness. The mark over the A in STATES might be a shadow from a scratch on the holder. On the first coin, is there a smudge on the plastic that is causing lack of detail on the shield?

Zurie - The seller confirmed that what looks like wear on the shield is actually a slab issue and not on the shield when I questioned the unusual wear for the grade.

If I get the 2nd one and take it out of the slab - would it get back a semi-decent color in ten years?

I ended up taking the 2nd (the one with the CAC sticker) , and I think I made the correct decision. The seller seemed to have severely overexposed the shots. It's a really nice coin with amazing luster on the obverse - I forgot what it's called but it looks like a bar of light that twirls in a circle as the coin is tilted up and down. Thanks for helping out, CCF.

Yes, that looks much better. The term you are looking for is "cartwheel luster."

"Severely overexposed" is right. You made the right choice. Your pics make the 2nd coin look more like the 1st coin from pg. 1!
