The plot thickens.... The seller responded to my latest offer to send back the coin, saying that he thought the issue was resolved in his favor and that he had the money so he doesn't have a problem. Meanwhile, ebay has paid a full refund of $327 into my PayPal account as of yesterday. They also sent me a new email saying the case was closed. Does anyone believe that ebay would just fork over cash and not expect me to return the coin? I would certainly expect them to hit the seller for the refund amount. Like, immediately! More ummmms:

Negative feedback is in order ! He clearly violated his own money back guarantee.

Sure, there was an address on the package but I wouldn't just shoot the coin back, without a confirmation from the seller that a) he agrees to accept the coin, and b) the address is correct. That confirming email will be added to my collection of emails from this transaction. That collection plus my mailing receipt with delivery confirmation will protect me in the event that he later claims he never got the returned coin. I'll keep all my emails in my ebay folder for at least a couple months after it's all over. Of course, I won't be doing any more buying from this character.

there is one flaw I read here. ebay will not refund your money until you can prove you have sent the coin back. So there is no way you will get your refund and then send the coin back, you have to prove to eBay/paypal that you sent the coin back (with signature confirmation, not delivery confirmation) and once you have that proof they will issue a refund. This is how I have always seen it work anyway, I have never seen anyone get a refund and then them send the coin back. That is a seller only option there where they get their money before you get your product

Jaobler is saying he got the refund already, so I guess ebay's policy is not consistent. Did you send the coin back yet, Jaobler?

I had a friend a couple of years back that thought he bought an ASE proof but he received a bullion ASE. The seller wouldn't respond so he filed a claim and got a refund but never returned the coin. Sounds like a similar situation.

Still no new communication from the seller or from ebay and the money is sitting in my PayPal account. Guess I'll not worry about it for now. I'm still looking for a decent, un-cleaned half eagle!

I recently filed a claim with ebay on a seller who sent me three counterfeit Japanese Trade dollar coins. He continuously insisted that even though they weighed 19 grams instead of 27 grams that the difference was wear- they were XF instead of BU and that took off almost 1/3 of the weight. ebay decided in my favor, and had Paypal refund my money even though I vehemently said that I would NOT return the coins, as the seller would just turn around and resell them to someone else as legitimate coins.

thats interesting, I have only had to escalate 1 complaint and when I did I had to send the item back and have signature confirmation that it was received before I got my refund

I did offer to send them to anyone ebay wanted to verfy that they were counterfeits, just not back to the original seller.
