HR 5977 (Collectible Coin Protection Act) Before Congress

I wanted to put a post out here to get everyone in the CCF to contact your congressman to encourage them to support HR 5977 which makes it unlawful to:
  • Sell unmarked replica coins
  • Provide assistance to someone importing, manufacturing or selling them
  • Infringe trademarks (PCGS, NGC, CAC, etc...) in connection with replica sales


Here is a link to the ICTA site where you can find out who your Senator and Congressman are and send them an email:

Click on the "What's New" tab and you'll see a direct link to locating your Senator / Representative.

Please drop a short, concise, to-the-point email to your Representative uring their support of this bill.

Aww... Although I completely support this bill in spirit, it's gonna make working on my counterfeit collection really hard. Especially provision D:

For all I know, if it passes, going down to the local Cash for Gold place and buying their duds could land me in jail.

Also, "consciously avoids knowing"? What thought-police speak is that?

Anyways... I am torn.

The way I read it, the bill is basically saying "don't sell replicas (counterfeits) that aren't marked as such." Also, "don't alter existing slabs or make fake ones."
Seems like a great idea to me.

If I avoid a store because I know they sell fakes, but don't report them, I will be in violation?

Even if you were it wouldnt matter. Theyd never be able to prove it unless you were in their books or something, and even if they could no one would care. No prosecutor is going to waste time before a judge saying "judge this man refused to tell on that shop"

- probably directed at a large well-known-mulinational-on-line auction site -
the fact that they allow sellers to compose their own listings, and the site sits back without any review of those listings, when everyone knows that fakes are being listed, in large numbers, every day - that sounds like
"consciously avoids knowing" to me. In some areas of the law, this is sometimes called "wilful blindness".

An Act of Parliament is a wonderful thing, but it needs to be followed by enforcement at both the investigative and prosecutorial phases, if it is to be effective.
