You are correct, that is not an overdate. Good Luck with the seller.

Well, I'm a newbie to the art of coin collecting, but have noticed two features with the overdate penny 1) the tip of the secong three has a "point on it", and the back of the three has a little bump or along it. This is not always easily distinguished by the naked eye. I'm not sure if the number position is different, the normal "33"'s look a little wider, although I've not measured them. The second 3 also seems to sit a little higher on the overdate. Not sure of the denticle/numerical positions. I recently aquired a kingV bulk penny lot, and I believe I got an overdate from it, as well as normal one. Here's what it looks like, as well as a what I belive to be a normal 1933

I honestly couldn't tell the difference until I put it under my little 43X microscope. In fact, I wasn't even sure it would show up in the photo(s) when I took it! I have noticed that some overdates are easier to see than others, and there may be other features/characteristics that seperate the two, I'm not sure.

DO you find 43x zoom to much or can you pan in/out?

No, it's just a little cheap hand held thing with an led light on it, as soon as I try to adjust, it just loses focus. The 43x zoom is pretty good, but I have to put it on the surface of the coin and concentrate on small areas. I bought a 10x magnifer with an led light on it, from the post office, but for me, the 43x zoom is better.

If it was an expensive buy I would take it up with ebay and possible law case if you want for misrepresentation and possible damages.

I will just see what he/she replys There has been a plague of ordinary 33's listed as "overdate" or "possible overdate" the last few Months,i don't know what has caused it as I've been on ebay Oz. for 13 years and have never seen it before.
