Can A Seller Do That?

I was just looking at some auction on ebay and I found one where the seller specifies that lost item won't be his responsibility.

"Items shipped without insurance are at the risk and responsibility of the buyer and I will not be held liable or responsible in case of lost and/or stolen mail."

Can he really do that? I always tough that lost items were the seller responsibility.

If you pay by PayPal you will have buyer protection. Doesn't matter what the seller says.

Just like any other retailer, it's on the seller to get you the product. With that said, a seller who uses eBay-acceptable tracking information will be covered if that information says it was successfully delivered. Loss/damage remains the seller's responsibility. Doesn't matter what the seller disclaims.

I actually get what the seller is saying. If you want to buy insurance you can. However, if you don't, it won't be his responsibility if the post office loses it. It has happened to me a few times and it is very annoying. Sounds to me like the seller is trying to encourage insurance.

You don't understand how it works. Insurance protects the seller, NOT the buyer. The seller will be responsible no matter what nonsense garbage they spew in the listing.

If hes selling from his own website he can dictate terms like that, but ebay policy will overrule any terms you put in your listing.

The general problem is that postage and insurance is just so expensive in relation to the price of many coins sold on ebay. If the tracked option is enforced (which is the aim) those coins will just disappear from the listings.

Seller will be responsible. One time I bought an 1875 IHC in high grade, but it never showed up. The seller sent it with tracking, but no insurance. I visited the post office for 2 weeks looking for the coin, and I still visit the local coin shops hoping the thief will try to sell it. My guess is that my coin was stolen off my porch, by a roommate, by the postperson, or it was simply lost in the mail. In any case, the seller took responsibility and refunded me. I didn't file a complaint with ebay, and the seller volunteered to make it right.

Yes, ebay has Buyer Protection. I would disregard what he says and just automatically open a case if the item doesn't arrive. If the cases escalate to customer support, it will go on his record.

True, it would defeat the purpose of bothering to sell the coin. The seller would ending up losing too much money. If the buyer absorbs the cost it will be too expensive and they won't buy it. ebay and Paypal buyer protection is paid for with the fees you pay, I would just use those. As I mentioned though about this seller, I would not buy insurance because that is what benefits them not the buyer. If he didn't want to remedy the situation when you file a claim, just escalate it to customer support and have it go on their record.

Would you guys still do business with someone stating that in his description? Ok, paypal would protect me, but ins't it safer to avoid?

Sure I would, if there weren't red flags in their Feedback or something. I know the system would protect me, and the actual percentage of "problem" transactions is vanishingly small. They just get a lot of press when they happen.

If seller doesn't have a tracking number you can get your money back via paypal buyer protection.
