Unfortunately it is still only immoral and not against eBays rules now.

I advocate that buyers should be educated and do not buy into the crying game too much when someone whines they got taken advantage of when they had the tools at their fingertips to avoid that situation (and have caught flack for that on a couple of occasions). However the examples that g048406 finds are more than just "use your judgement"; they are examples of a person flagrantly trying to rip someone off when they know what they are selling is not close to what they are purporting it to be.

Illegal? No. Immoral? You betcha.

OK, so this particular case seems to be a bad actor. He was the winner of that Heritage auction, right? And we know this for certain?
But anyway... I'm from a family of LEOs and lawyers, and we think about some things a little different than normal people. My first thought was that some random clerk at ebay is now the decider of a seller's intent? Should ebay investigate every raw coin's history? Most of the coins in my 7070 were cracked out - was I supposed to document the TPG's opinion of grade and be bound by it should I choose to sell one on ebay? How many times here on CCF has a TPG's opinion been debated? TPG's like PCGS are famous for making HUGE errors, even slabbing fakes, so how can ebay rule based on someone else's questionable opinion? Some treading lightly might be advised here.

No, I believe that is what g048406 was doing for them And yes, we often disagree with the TPGs but IMHO the problem is with a small subset of people who knowingly rip people off. Not the ones who see a details slab that is from a wipe a long time ago and disagree with it; I am talking about the ones who crack out something that has been scrubbed and has no numismatic value, use deceptive photography and software to create the appearance of value.

I believe they were reviewing complaints and acted according to their staff's findings. If they ultimately decided that crackouts were OK, that is one less thing they need to do.

Ok, So if you look at the listing now, the note about the so-called die crack is gone and here's the best part, so is the die crack.. Any more doubts about this seller's intent?

This seller is some piece of work....He supposedly sold this coin for $2200: http://www.ebay.com/itm/1852-20-Gol...ht_222wt_922 (I say supposedly because he has made the bidders identity private), yet, he also just sold this same coin for $2002.00: http://www.ebay.com/itm/1852-20-Gol...t_150wt_1219 he has now listed that same coin as a buy-it-now for $2,499.04:

So are the reed marks in the field near Liberty's eye--erased on the picture, but no doubt still on the coin!
