We just reported 3 more sellers for copyright violation. When we gave the warning on Jan 14 it was not meant as a DARE!

To answer the OP's question, it could be hard if you don't have good equipment.

This is not a copyright violation or intellectual property issue; it's just an ebay policy issue. "Images and text policy Policy overview ebay members are not allowed to use images- including photos and other pictures- or text they didn't create themselves. Exceptions to this policy would be if they are authorized to do so by the owner, its agent, or the law....." http://pages.ebay.com/help/policies...ge-text.html

Wouldn't you be violating RCM copyright policy only if you copy/paste their images from their website? If you take a picture of the coin you bought, in your own home, I highly doubt it violated RCM copyrights. But if someone uses the picture you created in your own home, then that violates ebay policies

" ebay members are not allowed to use images- including photos and other pictures- or text they didn't create themselves. " And if I take someone else image and edit it, the new picture is created by me right?

By definition, editing is not creating but in this case, I suppose it would be ebay who decide since it's their policy.

So is this a copyright violation? Link: http://www.ebay.com/itm/NEW-2014-AU...e9f43&_uhb=1From what I gather from reading this and similar threads, it is. The seller has taken the Mint's own image and put his/her/its own watermark on it, and using it for a commercial purpose.

I would say so. It comes under the same understanding we have to not release any pictures before the mint says it's public. Though that picture is in the public realm, the mint is clear on how it may be used. Posting on this forum - Okay. Using it to sell for personal gain - not so much. from the mint's legal department: Use of website contents Reproduction, transfer, distribution or storage of part or all of the Contents in any form without the prior written consent of Royal Canadian Mint is prohibited, unless otherwise specified. However, Royal Canadian Mint consents that you may download one (1) copy of the Contents on your computer for your personal, non-commercial use provided you keep intact all copyright, trademark, and other proprietary notices. You shall not modify, reformulate, adapt, alter, adjust, change, disassemble, frame or decrypt any of the Contents of this website. Yet the RCM doesn't seem to care much of the most important issue, counterfeiting.

If an image is of a silver coin, I have seen some on ebay with the seller's reflection. This would keep others from using it.

Quote: Isn't this fun? It is! I love threads like this. Especially when experienced members contribute and share their learned understanding of legal matters. As an aside, the topic pertained to an individual's photos being used by someone else, rather than images from the Mint's website. (Which is another subject.) If we photograph a product of the RCM, we are capturing the product of an artisan's work without giving due credit, usually. If someone else posts an image that we captured, they are using our photographic efforts for their benefit. Whether they don't have the ability to photograph their coins, or are too lazy to photograph or scan the coins for themselves, the photographer will feel that his/her efforts have been swiped. But it is going to happen. Yes, you can use ebay rules to retaliate, but is that a good use of your time? Perhaps, for one's own peace of mind, it might be best to look at it as a form of image creation flattery. And be happy for your photographic capabilities.
