Not in my opinion.. Hair above ear, coronet and cheek indicate wear. Too many little dings. I would call it VF35....TPG XF. May be the lighting but color looks a bit funky?

sellers pics do make the color look a bit orangish. I bought an 1849 a couple weeks ago from same seller and the coin was a nice light brown in hand.

Almost AU. I'd say XF-40 or 45. I suspect it may not have original surfaces.

I see too much wear on this one for an AU. I would go with XF40.

nobody commented on the scratch by the neck on obverse. Not sure if would be gradeable because of that. Amazingly I did not notice this while bidding. Seller has not shipped it yet and I am thinking that scratch would be bothersome to me. Any thoughts? Also not sure of resale value if I did try to resell later.
