I think a dark photo is under-emphasizing the details. I'm leaning more towards EF40.
You spotted that on ebay? Well-done!

I found this article from 2009 that tells about the clashes for this coin http://www.pcgs.com/News/1857-Flyin...Double-Eagle

Any updated estimates on how many of these are out there? The article mentioned that some believe 60 survive, however the author thinks it's about half of that.

Yeah, this is full XF imho too. I think there is some strike weakness on the bottom right of the obverse and the bottom right of the reverse. But given the rest of the coin is XF, the strike related issues should not lower the overall grade.
