1850 Large Cent, Open Or Closed 5?

I know it sounds like a strange question. The 5 is obviously open, but many other "closed" 5 examples are also open like this one. Some are really closed, but some look like this. The "open" 5 examples I've seen are markedly more open than this. I have this as an N-23 if open, and an N-12 if closed. The lower left foot of the 1 doesn't actually touch the denticle, it just took a hit and smashed it into it imo.
