Well I am out of luck I think; the Package was delivered and signed for. I would have preferred the buyer to have refused to sign since it was damaged.

Until ebay rules against you, you are not out of luck. Follow the dispute process to a "t" and do not cave in. The Buyer (or his employee/agent) should have NEVER signed for a package that they "said" was damaged when they received it. Heck, for all you know the person that signed for it could have signed for it, opened it, removed the contents and then told the boss that the package was already opened when he received it. My guess is the letter carrier might disagree with that assessment if questioned. This whole thing stinks like a rotten egg!

Talk to PayPal and explain what happened. There's a good chance they will refund you AND the buyer.

I can't do that until after the 4th that when ebay will rule on the dispute then I can appeal if I think I have been wronged .. I hope that is the case its not a huge amount of money but its enough to hurt right now.

So an update ebay found in my favour since the items were signed for. Now another claim has been filed saying the items were not as described and he wishes to return them. so I assume I will have an empty envelope sent back to me. This is getting bizzare. I was going to send the guy some replacement coins similar to the ones he bought because I felt sorry for him now I am not so sure. Surely ebay will see the item numbers on the first and second claims match. and that the reason for the first claim was an empty package.

That IS weird , Try ringing ebay and actually talk to them instead of emailing.

Someone here just doesn't quite seem be on the right elevator floor. They found in your favour and the scammer is on to scam number 2, which won't wash . You win he loses. ebay is not going to rule in his favour. Just when did all of this happen, you do not seen to have sold much lately , looking at your ebay feedback?

I have just sold 22 items over the last three weeks. this was from the first batch of sales about three weeks ago

How can he return something he originally said he never got but that he (or his agent) signed for? Even ebay can see through this...(hopefully!). Keep us posted.

Last update he appealed the ruling and ebay deducted the funds from my PayPal account. I am done with ebay and closing my account after 15 years.

You have to do what makes you happy and if closing your account makes you happy then do it.
So, did he return the items that "we're not as described" that he said he never got in the first place?

File a BBB complaint. I think you can do that even though you're in England, right? ebay will respond to you...within a day or two of when they last can (at around the end of a month after you file the complaint), but they will respond to you. Call them out publicly on their actions, they won't like it.

Since the items were "lost" then no they have not been returned. I followed eBays instructions to the letter. There was no discussion with me just a notification that the funds had been deducted. The buyer did not respond to any of my attempts at communication either through ebay or outside. I am not a huge seller. I do maybe a thousand dollars average a year but that's been the same for 15 years this is just my breaking point. The point where the return on investment does not warrant the effort put in.
