More obvious trash in the marketplace. As I've said before, it'd serve this seller right to have to sell it at the minimum bid and eat the shipping on the deal, too.

I've had all I can take of this. ebay needs to be prosecuted.

It seems like ebay periodically gets a handle on this garbage, but that sooner rather than later this sort of stuff gets back up on the site. These items are like the cockroaches under ebay's sink, so to speak. That said, I still think you're right insofar that ebay's not nearly proactive enough with regard to policing the problem. If I can find these listings so easily, why can't ebay have someone (in house or under contract) who's ferretting them out daily? Why do we as members have to report these violations?

My understanding is that the arrangement whereby such input was directed to ebay has been disvontinued. My impression is that it was in any event somewhat informal and ad hoc, and probably didn't come close to fulfilling ebay's true obligations, anyway (and that isn't meant to denigrate the people who participated, it's just that ebay shouldn't be relying in the first place on their voluntary contributions to get this right).

ebay had a handle on it, and then they fired all the people who did that and abandoned caring about it.

ebay firing those people was just completely illogical. They did have a good handle on it too. It's like the pressure of doing the right thing just became too much of a burden for ebay. Perhaps it interfered too much with making money.

Obviously. Now, though, they are in violation of law by allowing sales of counterfeits when they know better (thanks to our reports and everyone else who does). The law has changed since they disbanded CCW.

And 15 US Code §2102 gives me something to do about it.

I wonder if this case had something to do with it. Of course trademark infringement is different than currency counterfeiting, but it appears that ebay can just wash their hands of any responsibility. The way I read this outcome, they don't even have to ban a seller who lists multiple counterfeits, and they are not responsible for policing it.

Not any longer. Read the Hobby Protection Act - 15 USC §2102 et seq. A modification was signed into law last December making knowledgeable facilitators equally liable. That's what frustrates me about this whole affair - law exists which we can prosecute ebay under, and all we're doing is talking about it.

Not if nobody does anything. And I don't really care if it goes to court. We don't want to shut ebay down, we just want them to do what they've successfully done in the past. I'm hoping a shot across their bows will be enough.

ebay says "member since Nov 06, 2005" - seriously? Almost 10 years?

As far as I can tell, every one of their 15 items is counterfeit. I see no link on the seller page to report them. I've spent 10 minutes digging around and the only options I find are for reporting individual items. Is there a sticky on this forum for how to report someone as a seller of counterfeits? To me there is clearly a pattern of "hear no evil, see no evil" on ebay that deliberately makes it difficult to go after these people. The original coin above was re-listed, and I reported it 6 hours ago. It's still active. If the law quoted above has any teeth, just this one example should be enough for prosecution.
