OTOH, it would probably be much harder to sell stuff like Henning nickels (or any other sort of contemporary counterfeits, which can often be more valuable than the real coin they copy).
Not that this sort of stuff isn't hard to sell already.

While this particular lawsuit zeroes in on a specific counterfeit product, it'll be interesting to follow it through to see what happens to ebay's practices regarding counterfeit items should they lose the lawsuit.

I think the main job for the prosecuting attorneys will be to PROOVE that ebay knows 'pre-sale' that an item is counterfeit. I'm giving ebay an 85% chance of winning.
I'm also surprised that the delivery companies (USPS, UPS, etc.) aren't doing to be sued too. They get their cut of the counterfeit money just like ebay, Amazon, etc., etc., etc..

Living in socal that lawfirm sounds familiar. To the point that I think they are the tv commercial tort type. I could be wrong but if I'm not it doesn't bode well for a serious lawsuit I would think

Obviously, ebay cannot confirm the authenticity of all the goods on the website. There's far too many items. I say they'll walk away from this since they are not actually the seller. However, they may crackdown harder on offenders as they get exposed.
