so I tell him they are 2 different coins,in 2 different photos I went ahead and bought the coin, knowing if it is fake I don't lose..but guess what I can't pay because the person is not verified on ebay, so I cancel the transaction, and I write the person and say, send me the coin, if it is real I will send you 500$, if it is fake you are out of luck,, what are the oidds I will here from them..

The obverse is not from a 1948 coin. It contains the ET IND IMP which was gone in 1948.
That's the reason the dies were late that year India gained independence so they had to
change the obverse die, the King was no longer the Emperor of India. They were waiting for
new obverse dies that had no ET IND IMP ended up only minting dollars in Dec of 1948. 1947 ML's
prior to this in 1948.
Buyer beware if that is what they are selling.

I wouldn't say it counterfeit, I think he just doesn't have the coin or maybe a clue what he's doing. It could really well be a picture of a real coin. However just because I can get a picture of a car online doesn't mean I have one to sale or that I have good intentions.

The seller has a couple of devices for sale with photo capabilites (if authentic) so "borrowing" a photo is no excuse. I think it's a counterfeit 1948 as well and the seller is aware of removal of fake listings so to get around that they opened a new ebay account and used a fake photo. That this forum is active in counterfeit reporting and also the source of the photo is likely not coincidental. Just my opinion.....
