Since this is US and Canadian, I'll put it in this forum, but being that it's a local story to me, I have to wonder what coins there are in that estate, since they listed the coins first. I did not know the guy.

This is a tuff one emotionally but an easy desicion. While it's a despicable recipient, who is the government to tell a man what he can and cannot do with his property, either in life or probate. They'll probably just spend it all on meth anyway and will disband within a couple years because of it

I agree with Cascade. Unless the neo-Nazi group is illegal in Canada, they have no right to say what happens to the estate. If they are (to the extent that a member could be arrested for having membership to the group) then the government has as much right to interfere as of the collection was willed to Al-Qaeda or ISIS.

This is a hard one for me.

The pros and cons keep bouncing back and forth in my head.

In the end I feel I would side with ... The government should not be able
to decide who someone can will something too.

They say they wat to overturn the will because the recipient is a hate group whose activities are illegal in Canada, but they are based in WV. Do they carry out activities in Canada? In not you are trying to deny them for activities that are or maybe legal where they are located but which would not be if they were carried out there. That's like saying we should send tickets to all the motorists in Great Britain because they don't follow our traffic laws. Sorry they do something IN Canada that is illegal in Canada OK I could see denying the inheritance otherwise no.

If I willed my inheritance to Charles Manson, (fan club or family)...the government can't step in and say that is an improper or inappropriate recipient....

...BUT if you willed thousands of dollars to a terrorist or terrorist group, the government can step in and seize the funds. I can't send money to the IRA to make car bombs, even if it isn't American police they will be blowing up.

Canada has laws against supporting "hate groups" and if any group qualifies as a hate group, it would be neo-nazis.

(Mind you, I am still of the opinion that the Canadian government should butt out in this case)
