It's kinda hard to tell without being able to zoom in on the coins at a high rez to look for marks on the fields, but I think both look about the same: MS60.

That's one impressive die crack on the 1940. The 40 being a wartime coin makes it a little better in my eyes.

With the photos provided I would be leaning to au50-55 for the pair. Looks like the sideburns are worn right off, and white a bit of chatter especially in the 1940. That being said, still nice coins

I'll say 63RB on the '37 and AU-58 on the '40.
