First, it's NOT a 3-cent nickel. It's a 3-cent silver.
It looks like a VF-something.

Strong XF45 almost AU50. Maybe details due to porous looking surfaces at the stars. Maybe environmental damage.

in hand it appears to be rust on the die leading to the porosity look around the outer ring on the reverse. this coin looks better in hand that the pictures show.

I was thinking 45 until I saw the reverse which looks like it's two full bumps higher to a 53. Hate it when I split grades as it's very unusual in "real life".
It's certainly a 50 for a single grade.

This coin is tough to grade. In the obverse you get a real sharp star, but the shield outline and the rim look weakly struck. It doesn't look like wear but weakly struck on the right side. On the reverse there is a die crack and a Cud at 2:30. But the reverse looks well struck, even with a cracked die. Couple of ring dings at 8 o'clock. I would put it at XF45 with the issues. A lot going on in this coin. I think in spite of all the issues, it is an attractive coin that has nice color. I have seen a lot of ugly ones and I like this one.

Thanks Folks. I took a gamble on crappy seller photos and was pleased when I looked at it in person today. the die crack is rim to rim 10 o'clock to 2 o'clock. I am a little perplexed by the obverse rim. don't know if there was a strike though or what but the mushy rims are odd. definitely a late die state too.

I'm thinking the obverse is XF40 given the wear on the shield at 8 o'clock and whatever is going on at the opposite point.
However, the reverse has me thinking VF given wear on the diamond and at least a couple of the orbs.
