Hard to tell if it's Unc from the pictures. Pretty flat on the hair above the ear. I'd bet AU 58. Too many dings and hits. Could be Unc, though. But it has way cool clash marks on each side. I'd buy it for the clash marks.

I think this coin has obverse surface damage and is unc details. The areas to the left of the nose, the right of the eye, on the neck and the right of the cap and hair in the field do not look like contact marks.
The toned reverse is stunning.

This date is fairly common on the Bay. I think you can find a nicer example if you are looking to buy one. I would give this one no better than MS61-62

Seller had it listed as ch unc. I went ahead and got it for $47 to fill the album hole. Price is right if the consensus is AU+ Not really interested in slabs unless it's a good deal. I crack them open
