Not FSB, unfortunately.
For FSB, tops of the bands have to be like the tops of loaves of bread, with an obvious groove between. A bit more obverse detail than usual for a 1940, especially on the side wing.
Grading wise, 62 would be near the mark.

MS-62 , agree on cheek scratches . and I'm not a fan of black oxide on silver coins .
