I just got an e-mail from ebay about a new user agreement.

At ebay, we strive to make our policies clear and our services easy to use. As part of that commitment, we're announcing some changes to the ebay User Agreement.

Our updated User Agreement will take effect on September 19, 2017 for new users and on November 1, 2017 for all other users. The updated User Agreement was posted on ebay.com on September 19, 2017.

The key update to the ebay User Agreement is that we've made it clearer how we address violations of our policy on offers to buy or sell outside ebay. Sellers who violate this policy may be charged a final value fee for the applicable item, even if it doesn't sell.

Thank you for being a part of the ebay community.

Sincerely,
The ebay team

Thoughts?

I don't see how they can enforce this. This is not a new policy, and there are numerous sellers who have the same inventory on ebay and on their own sites. ebay is just adding a new form of punishment that allows sellers to keep doing what they're doing while ebay can take their cut, if they choose to do even that.

Likely just trying to scare people. I don't see how they could charge a fee for something that didn't sell on ebay especially the even if it didn't sell part if someone really wants to challenge that. If they're serious about that they're going to watch sellers leave left and right

Sounds like the local realtor that tries to collect a commission on houses that sell by owner after his 30-days are up.

If there was a great alternative to ebay, people would have left already. They know they practically have a monopoly and that's why they're not worried about the repercussions of their policy changes.

Right, just a scare tactic. Don't see how they could track this unless...unless...

I've been approached by potential buyers to stop an auction and sell directly to them a zillion times. In most cases its for a rare item and they just want to make sure they get it.

I advise them to bid high because I don't stop auctions unless I made a mistake. This could be an area where ebay could follow such a discussion.

Perhaps for those bone head sellers who kill their auctions at the last possible moment if they don't like the bid price (even though even newbies get used to that last six seconds being the prime bidding time).

Then they say the auction was closed from an error or BECAUSE IT IS NO LONGER AVAILABLE. I'd love to see those humps get nailed for the pull.

They are cracking down on people providing email addresses or phone numbers via ebay's messenger with an implied "lets take it offline". There is nothing they can do about people using ebay to advertise using a store name that is the same as their website and selling things on their website for 10% less. Or just having a website with an email and phone number saying call me for discounts on ebay items. Does anyone really buy big ticket items from usernames DavidLawrenceRareCoins or HLRC without calling them for a better price?

But if you make a sale via PM and provide contact information, they will charge you a Final Value fee. Of course it is enforceable. What are you going to do about it, sue them?

Someone will for sure. You really think someone won't if they really plan on basically taking a final value fee out of whatever they want anywhere they want especially with the even if the item doesn't sell part?

The way I read the new policy, it sounds like they plan to collect fees on ANYTHING that ends unless it times out. I barely sell anything on ebay anymore; the fees really add up and make it tough to make a profit on anything.

Wrong. They intend to penalize the exchange of contact information regarding items that do not sell to prevent people from using ebay as unpaid advertising and then avoiding fees. If you don't break the rules you agreed to, you won't see your fees go up.
