Wearwise, it would be a 45 or 50, but it's been cleaned with some strange surface oxidation. Your coin (in old terms) is a Zoell R2c which has a common Obverse with a DP#5. The old designation of a DP#5 is a Zoell R2b.

There's a lot of crud in around the lettering suggesting that if this coin was cleaned it was done very lightly and a long time ago at that. I like this coin. EF45
What does everyone think this was cleaned with?

My guess would be EF in cleaned condition, nice variety find of one of the 1859's

Again thx everyone . As for the "cleaning " the dark area's are very shiny  so my first thought was slight PVC damage. Would that cause the discoloration on the rest of the coin?

Well, ICCS NEVER does note any cleaning or other questionable surface contamination, so it will probably come back as EF-40-45 .... but the coin is unsaleable as it looks right now. Why ICCS is the sole TPG that fails to mention anything in notes is beyond me .. but it's the reason that many collectors won't buy ICCS coin sight unseen. Any other TPG would bodybag it.
