It is hard to tell from the photos whether there is rub on the high points, particularly on the obverse. This would determine whether this coin is AU or MS.
There seem to be some pit or contact marks in the obverse field. Also, it is difficult to see if there is a split left hand or not (clear thumb showing). If you could post a clearer photo of the obverse, it would help. As an initial guess, I would say AU55 or MS 63/64.

There definitely appears to be some wear, I would go AU-50.
