I found this decent example of a 1939 D Jefferson nickel in change but I think this is the reverse of the 1938? I do know you can tell by the style of steps as to which reverse was used. I just cant tell. I don't collect Jefferson nickels but thought I would keep this one. Insight please.

Normal 38 reverse. The '40' reverse shows edges to the steps. Thus when you compare the two together, you would see an old die versus the new die for 1940. So because the die looks so bad, it would have to be a reverse of 1938.

I leaned that way Mr. Coop! And thank you IndianGoldEagle! What made me ask was the pic with the Mintmark, you can barely see the trace of the steps.

I've been looking at these trying to find, differences besides the steps. They seem they were reusing the some worn hubs for something thing seem different on some coins and not so on different coins. So I tried proof coins as they have less wear on the dies. I did see a couple of differences, but die wear could account for that. But this is what I figured out:

On the reverse business strikes, they all both the 38 & 40 reverse look very weak. But I tried to find differences.

I guess the the only thing that was consistent was the green arrows above the windows of the 1940 reverse. There are thicker frames on the top of those windows. on the reverse of 38 they are thinner almost none existent.

If the sills are taller, then it is a 40.

Can't see it well enough on your coin. But there is a big difference, Amost nothing there (38) and a thick frame above the window.
