Keep in mind that the highest points on the coin are the deepest part of the die, so die clash there is pretty unlikely.

True in almost every case. The Incuse Indian clashes were Incuse so when the transfers occured the clashes became incuse as well. Another example is the 1918-S buffalo clash-01. When the EPLURIBUSUNUM clashed with the obverse die it transfered a negative image so when the coin was struck the clash was incuse.
