I signed up for his newsletter for kicks and grins but was wondering if any one else received this email;

Dear Our Valued Customers,

We normally use this email list to advertise our specials on ebay as well as our website. We wanted to take the opportunity to explain a situation that has affected us and may have caused some of you concern, and we think you will be very interested in what happened.
Some of you may have received an email from ebay stating that our listings on our ebay User ID Mikescoins1 were cancelled. You would only receive this email if you had bought from an active listing, however, since some of our listings are ebay store listings you may have received an email from orders as old as six months ago. Because of this we felt it was neccessary to let everyone on this list know about the situation as soon as possible as the amount of time it would take to determine who actually received this email from ebay might take days. As you can imagine, we have received some emails from customers worried that they will lose their money or otherwise not get their coins.

We think you will be interested to learn the reasons behind this, and we encourage you to read the rest of this email, but first and foremost -- rest assured that absolutely everyone who has an active paid order will promptly receive their order. The majority of people who received the email have already received their order. Please do not panic and put chargebacks through your credit card or Paypal complaints as there is nothing to be concerned about.

Now, let us explain what happened. If you are an ebay seller as well, or if you use Paypal you might be especially interested.

Back in April, we had an international transaction with a company in New Zealand for $6,000 in silver coins through our website where the buyer paid by Paypal. We shipped the order according to Paypal's seller protection standards and also insured the package through our private insurance company. The package took about two weeks to arrive, which is normal for an international transaction. The US Postal Service and New Zealand Post both confirmed delivery, however, New Zealand Post did not get the requested signature confirmation that should have been obtained by the delivering postal employee working at New Zealand Post.

The day after we confirmed receipt, the buyer put a Paypal dispute in claiming non-receipt. As you may know, Paypal finds sellers guilty until proven innocent in these cases and the money was instantly removed from our account. In the comments section, the buyer stated that "the tracking number you provided does not confirm delivery". This was especially interesting considering this was before we were providing tracking numbers to international customers, so unless the buyer had the package right in front of them they would have had no way of knowing what the tracking number was.

We submitted to Paypal a screenshot of the USPS website showing that the package was delivered, a screenshot of the New Zealand Post website showing that the package was delivered, a letter from the USPS Inspection Service showing that after an investigation they determined the package was delivered to the addressee, and a letter from the New Zealand Post equivalent to the Inspection Service stating the same thing. Despite receiving all of this information, Paypal failed to render a decision in either my favor or the buyer's favor for three weeks on this case.

The buyer then instigated a chargeback with their credit card company since he failed to get a refund. The buyer also put a chargeback through on another earlier transaction claiming non-receipt that the buyer confirmed to me he received before putting in the $6,000 transaction. It is unclear if Paypal submitted the information to the credit card company to fight the chargeback on my behalf, or they failed to do so, as they have given me conflicting information, but nevertheless we lost the chargeback and we are permanently out $6,000. Our insurance company also would not cover the claim as they believe it was a case of buyer fraud and we can't really blame them for their conclusion.

Now -- to add insult to injury, Paypal froze our account with no explanation during the first week of July. Some of you may have been inconvienenced by this as you were unable to send payments. It took intervention by an ebay executive that we met at ebay Live to unfreeze the account. During this whole week, we had no concrete reasons from Paypal to determine the cause of this, except vague information from my Ebay/Paypal account manager Adam (who is the only Ebay/Paypal employee that has gone out of his way to try to help us through these issues) that it was due to a high Paypal complaint rate.

We thought the problems were over as the account was fully restored, but while we were on vacation out of the country in late July, the same thing happened, again with no explanation. When we returned, we eventually conferenced with a Paypal "risk specialist" who informed us that the reason behind these restrictions was a high chargeback rate. We explained the situation about the fraudulent New Zealand buyer and while the account was partially restored, a 5% / 120 day reserve was put on our account which wouldn't be so bad, except that the 5% was placed on ALL activity, including refunds, (which makes absolutely no sense) so if we issued a refund to a buyer, an additional 5% was placed into an reserve, resulting in 100% getting returned to the buyer and 5% put in reserve for a total loss of 105% of our money.

Now -- to the reason for the listing cancellations by ebay. ebay has now, effective Monday, instituted Paypal performance as a part to help determine ebay seller performance. This is patently unfair as sellers that don't accept Paypal are not affected by this change, but those who do can only be negatively affected by this change. While we have had some negative feedbacks that added this "seller non-perfomance" rate, what caused the listings to cancel apparently was a poor Paypal chargeback rate, most of which was due to this $6,000 chargeback. Mind you, this is a company that we have paid over $200,000 in fees to just in the past two years have done over $2,000,000 in business with and we never experienced a problem like this before.

Aside from our horrible experience, in general ebay and Paypal as many of you know have gone through a period of dramatic and tumultuous change with numerous rapid management and policy changes since the beginning of this year. Needless to say, it appears that ebay is no longer a reliable venue for our sales and regardless of what eventually happens with this situation, our ebay auctions will become a smaller part of our business, if they have any part at all, by the end of this year.

We do have two other ebay User IDs that we have used as backups and have many of the same listings we normally have on our Mikescoins1. Both of these user IDs have "raised" search standing due to excellent customer service and we were already planning to list more on them before this issue occurred. To see these listings, please click on the links below:

Walruscoins ebay Store
Mikescoins2 ebay Store

Please also take a look at our website, https://www.mikescoins.com. We will be expanding our website listings and lowering prices soon as well. If there is anything that is listed that is a silver item, we can probably give you a better price on the coins as the prices on the site do not reflect the recent drop in silver. Please email us with any questions.

And, if you have any other questions or want to comment on what happened, we invite you email us directly at support@mikescoins.com. We thank you for reading this and appreciate your support during this disruption.

Sincerely,

Mike's Coins

I had a dispute with this seller. Back in early Sept. 2007 I bought on a best offer, 1909 Indian cents. By the first week of October, three weeks later, I had received only 4 and by mid-November, a total of 8 out of the order. He claimed they were on backorder and my repeated emails to him largely went unanwsered as to why he sells coins he doesn't have in his possession.

After many more emails he finally agree to send me a partial refund in December, but he didn't get to it until Jan. A total of 4 months of frustation, lack of response to emails, etc.

Look at all three user IDs and you will find many unhappy customers. People complain about the slow shipping a lot, even those that leave positives. This, I believe, is because he doesn't have most of the material he sells. He has to go buy it and then ship it to you. People also complaing about overgrading, like he'll sell you an uncirculated coin, but will receive an EF and it is not worth returning it.

It does not at all surprise me that they suspended his one account. They should boot him off of ebay, all three accounts. There are so many good sellers out there, we don't need this one.

I should also point out that a few months ago, he started selling large quantities of Ike dollars for 1 cent no reserve and low shipping, or $1 with free shipping. This was done, I believe, to inflate his positive feedback scores, because he had dropped from 98.5% down to 98.1 or 98.2% after ebay re-did how feedback is calculated. But it still doesn't matter. He's now at 97.9%, because even some of the Ike dollar customers complain about slow shipping or some other issue, like never receing the coin.

He has 66 negatives in the last MONTH and hudreds of neutrals, and probably a lot of positives should have been neutrals, but people are being too nice.

Wow, that is some interesting feedback they have, unbelievable! Make you wonder why I took ebay so long.

Wow ... justice be done! It couldn't have happened to a more deserving guy. My complaint with him was picturing an MS65 coin and delivering an ugly AU ... you had to read the fine print several times to find a quick blurb that the pictured coin was "representative" of the one you would receive. Mike's interpretation of "representative" was a coin of the same type. My day just got a lot better!

It is interesting that Mike spend so much time writing a long letter to his "valued customers", the same ones who, when they complain, he ignores multiple emails and then finally when he does respond, it is a one liner. Suddenly, the writing juices are flowing from Mike...

It is interesting that no one posting all of this information on this forum had the balls to contact us directly with their complaints after receiving the email. Many of you are on our mailing list and received the email.

We have received over 120 positive emails from happy and supportive customers after getting this. Our other two IDs have had nothing but 100% positive feedbacks since we relaunched them. Both receive raised search standing from ebay due to excellent customer service.

ebay did not remove Mikescoins1 due to negatives and neutrals and it is false that the account was suspended. (otherwise you would see "not a registered user" next to the User ID). As it turns out, the listings were removed accidently due to a miscalculation by ebay. We are not relisting on this account right now because we are getting better results due to better search standing on the other two.

Out of the negatives we received on the mikescoins1 account, the majority were left by two people. One person left them after the buyer asked to drive across teh country to take me out to dinner and I refused, and the other tried to get free shipping where the listing clearly didn't say so, and was also refused. Neither of which have anything to do with the quality of the coins or the shipping speed, they were personal issues. ebay is investigating both of these accounts and will likely remove the feedbacks on at least one of the two.

For the poster who bought the 1909 Indian Head Pennies, the buyer also accused us of gouging him on the price (we had them listed at $8 each but after his protests we agreed to reduce to $4, at a time when greysheets have them at $12). We clearly explained to him that they were NOT in stock at the time and that it would require some time before the order was shipped.

As for the buyer who claimed we advertised a MS65 coin, we NEVER advertised any coin graded MS65 unless it was certified. We will sometimes give a range of MS63 to MS65, but we never guarnatee a specific grade, and certainly not MS65.

Our website business has grown substantially over the past few months we hundreds of happy, repeat customers. It's ashame that a handful of people try to make false comments and attempt to influence others.

Take a look, lafashionsense and keithmoller account for 31 of the 50 negatives in the past month.
The statement was true.

Yeah you're right, when you remove those, 19 negatives and 25 neutrals in a month is perfectly acceptable, I don't know what I could have been thinking.

Then there's the 300+ in the last year. You're seriously fighting a losing battle here, I'll get you another shovel for the other hand if you want.

Read that again ... it says pictured! And that's what I saw and you sent a crusty AU coin. When I emailed you with my complaint you referred to your fine print and use of "stock photos". I had to reread your listing several times to find any reference to this. A REPUTABLE and HONEST seller would have this right up front so that there is no confusion. You are neither! You also had a nasty habit of nuking everyone who submitted a neg or neutral feedback (old system) so I sent in a negative positive.

If you are here to repair your reputation in our communtity, good luck. I and many others here will continue to discuss our dealings with you to protect the community from your type.

I don't know how you can tell a coin is specifically MS65 by the picture. We do a big volume of business of common date coins and it would just be impossible to picture every coin. Our methods work for 98% of our customers. But, in any event, you are more than welcomed to return the coin, or, I'll just send you a refund for the difference between the price you paid and dealer wholesale for the AU coin on your word.

I'm not going to argue with people here that are trying to stone us. As I said, we received 120 (and growing) positive emails to our email that went out. What Paypal did to us should not happen to anyone. I'll post a few here I picked out randopmly:

------------
All I can say is WOW! I thought ebay and paypal would have stood behind the seller. I have bought coins from you in the past and everything went smooth. I will be getting more from you I am sure. I wish you the best with this matter.

Good luck, Gary

Dear Mike's Coins,

It's outrageous what has happened to you. I have had several fantastic transactions with you, and I support you whole-heartedly in your dispute with ebay and PayPal. I used to be a PowerSeller on ebay and have 4623 feedbacks with a 100% feedback rating. I haven't ever had any problems with ebay or PayPal because my category is low-risk (new children's clothing), but I became so tired of all of the fees and the lack of support for sellers that ebay just wasn't fun anymore. I began selling in 2002, and ebay was a great marketplace, and I felt like they at least cared a little bit about the sellers that were making them rich. But by 2006, I felt like they could care less about the sellers and were making horrible policy changes that filled their coffers at the expense of hardworking sellers like you and me. Truthfully, I can't really stand ebay and PayPal any longer!

I read your email with great interest and concern, and I cannot believe PayPal stole your money from you when you did everything right. Isn't that why we use PayPal—so we get seller protection from fraud? Anyway, I am seriously outraged about what has happened to you. I've been waiting for years for someone to come up with a viable auction competitor to ebay, and I was hoping maybe Google would, but it just never happened, unfortunately. I rarely sell on ebay now after it was a large portion of my life for 4 ˝ years. However, I did see that Amazon launched their own payment service to compete with PayPal. Maybe you could switch to Amazon Payments or Google Payments to accept payments on your website.

Again, I cannot believe the lack of support ebay and Amazon have showed you, especially with the amount of money they're making from your auctions and payments. ebay is just not the place it used to be!

----------

You have my support with any (almost) dispute with Paypal. Even thought they acknowledged I was right in a dispute with a seller they still froze my account and I was the victim! Someday-someway-somebody will put together enough money to challenge the lockdown they and ebay have. I hope it will be in my lifetime. Good luck. Ann

------------------
Hi there,
Just a note to tell you I think your letter was well-written and captured the issue very well. I am impressed with your writing style! Your explanation was perfect in every way, and it is unfortunate that you have experienced not only a financial loss but such a major inconvenience. Believe that people like me (missandersen)have a great respect for you and wish you the best in your future endeavors!
Sincerely,

---------------

It is extremely unfortunate that you have become another victim of ebay and it's 'Common sense along with Overwhelming Evidence ' to support your position doesn't seem to make any difference. You certainly have my support although I know that won't change anything with ebay and the way they operate. I myself have never sold anything on ebay, I've only made purchases and I have not experienced anything like what has happened to you and your business. I know I have made purchases from your business in the past and I have been 110% satisfied with your service, quality, and price for items purchased. I hope you are able to fully recover from the injustice done to you. It will be ebay's loss when/if you leave their service. It's really to bad they have become so big that they have lost sight of who made them so financially successful.
I wish you all the best in your future endeavors, and I would conduct business with you anytime.

------------------
This is incredable. How in the world does ebay and PayPal expect sellers to tollerate these outrageous policy changes. It leaves the seller wide open to buyer fraud like an invitation. I have considered selling off some of my coins on ebay but I am reconsidering. It is a shame that lawyers are so costly because I believe this is an ideal chance to take a bite out of unfair practices by ebay with a class action law suit. I am real sorry you lost your appeal and funds. If enough top sellers could form a group they could change the face of ebay for ever and maybe make it a safer place for sellers to make an honest living. ebay would listen because they are greedy and would shiver at the thought of losing so much revenue. May God bless you with good fortune. Dave

Scubu,

I agree and wish we never had any negatives and neutrals. We have improved customer service over the past year and try to do a better job in making sure the buyer received exactly what they ordered in a timely manner. The vast majority of customers are very happy with our service. We have had nearly 50,000 total positive feedbacks and 18,000 are from repeat customers.

If you sell on ebay you will encounter all sorts of buyers, reasonable and unreasonable, fair and unfair, honest and dishonest, etc. And then we get the crazy people and the competitors who bid just to damage reputations. You do not understand what we have to go through sometimes when it comes to bad buyers. If you had a specific problem with us we will address it, even if we haven't in the past. Some of our attitudes toward the customer as recently as a year ago have changed and we admit when we are wrong when we used to not.

I did look at the listings on the coins that this one buyer had a problem with on the shipping for mikescoins1. This buyer left many negatives (though they probably only count as one, because of being close in time frame). It turns out both sides are correct, and because of this, the seller should honor the buyer's claims. Let me explain, with link to one of these auctions.

http://cgi.ebay.com/ws/eBayISAPI.dl...370063738392

In the description of those items it says $3.00 shipping for first item, $1.00 shipping for each additional item, so Mike is right on that point. The buyer is claiming that shipping should be free for each additional item or at least should be only $1.00). Buyer claims he had to pay $3.00 for shipping on each additional item, which I don't know if it is true. Further down the listing at the bottom, it says "Free shipping for each additional eligible item you buy from mikescoins1! " What "eligible" means is not clear, but this buyer bought a ton of stuff at the same time, thinking he was going to get the free shipping. This is what the buyer says should have been honored. Since the seller has a discrepancy about the shipping charges in his own listing, he is ethically held to the buyer's claim and the buyer is correct and should not have had to pay all the extra shipping. So in my opinion, the seller deserves the negative FB he got. Seller's mistake, seller's responsibility, in my opinion. Customer is always right, or you lose future business. To avoid this discrepancy, take out the "free shipping for each additional item" at the bottom of the listings and you won't have this confusion.

I NEVER accused this seller of gouging, just that he had coins priced just the week before at a certain price and then suddenly jumped the price. I only asked him to honor the price from the previous week, not lower than that. And the seller nicely AGREED to my best offer, which was the exact price from the previous week, so it is a moot point. Seller could have just declined the offer. The seller DID NOT explain to me upfront that the items were not in stock until many, many weeks had past and I finally complained about the slowness in receiving the items. I think the seller KNEW he didn't have them in stock at time of sale and did not disclose this up front. This seller sells coins he doesn't have in stock, and I think it is routine practice. One can debate the ethics of whether this is good business practice.

Maybe this is just one bad experience and the seller deserves another chance? I can forgive and forget. I did forget until this thread was started.

Probably the real problem is that Mike does such enormous volume every month, that he doesn't have enough staff to handle all the orders and fill them in a timely fashion (or have people to order the coins form a third party). This suggests a business that is booming and perhaps it is time to hire additional support staff to handle the growing business?
