Au50 or 53. Most of the luster is gone and it looks like the obverse fields are hiding scratches. Likely market acceptable. Harsh lighting makes it hard to tell.

That's why, I love this hobby, think about it. 1863 was the year of the Battle of Gettysburg, that coin may well have been in some infantry guy's pocket.
