Would you consider this false advertising?

Not false but definitely misleading.
Especially without an historical explanation.
The example is not a racketeer nickel.
It is an example of a nickel, which when a gold wash was applied, was passed in commerce as a five dollar gold piece.

And as such should not be called a racketeer nickel.
It is a plain old nickel.

Rest in Peace

Interesting in their description they write, "It's not easy to ascertain whether you have a "genuine" racketeer nickel as they are all altered coins tampered with outside the Mint." They then describe theirs as a "Racketeer nickel" in the title which it clearly is not.

Didn't check the link until just now, but I don't have an issue with the wording as it stands.

I don't get what the false advertising statement is here. the seller repeated what is on the slab. do you think the seller changed out the top of the slab with a higher grade from another coin? the photos are poor so it is difficult to grade the coin. the only issue I see is the asking price but they can list a coin at whatever price they want

USSID indicates that some change was made, exactly what we can't tell.

That's correct GrapeCollects, thanks.

The seller still puts the Rackateer Nickel history in his description, which in my opinion isn't necessary or truly valid. He's just looks (picking at straws) trying to get any additional advantage to sell the coin.
