I won this 1858 3 cent silver on ebay for 21.50 including shipping on Aug. 7 & paid the same day. I waited for 17 days for it to arrive & then emailed the seller that it never came. I know it's not a lot of money but still, I paid for it & I never got it. http://cgi.ebay.com/ws/eBayISAPI.dl...WN:IT&ih=012Seller's Feedback is 100% Positive, so I don't suspect him. I paid with Paypal. He states on his ebay item page that "Insurance is not offered." He emailed that he has proof that it arrived. His response: "I have tracked it and you can do the same by going to USPS and typing in tracking number which is XXXXXXXXXXX. According to the post office, 'it was delivered August 12 2008 at 1:58PM Miami, Fl 33162.' Thanks for your concern and I hope I've helped." That's my zipcode but I never received it. I tried to follow up with the USPS but didn't get anywhere. What do I do now? Do I have any recourse with Paypal, the seller or ebay? Or am I stuck like Chuck? (Sorry, Chuck.)

I was in a similar situation over a Gameboy that I purchased. Never arrived at my place but the tracking number says it was delivered to my zipcode. Filed a dispute with Paypal but the seller won since he was able to provide proof of delivery. I lost about $78.00. Things would have been different if the seller had requested signature confirmation.

I think I remember reading or hearing from someone recently that the post office marks things as "delivered" once they reach your local post office. I would visit your local post office center for additional info.

A lot of rural PO's do not have scanners for the carriers. In fact some extreme rural areas the carriers are not even USPS employees, they are subcontractors. In these cases they are scanned all at once in the morning when they leave or as they are carrier-sorted during the night before.

From time to time you just don't get your coin delivered. It has happened to me a few times in the last several years and each one still really bugs me. Sorry this happened to you.

IMO, you cannot really leave neg feedback for the seller. Yes, he could have required sig confirmation but who does that for a $20 coin? The added cost is likely to run off customers and result in a lower final price. He did at least have delivery confirmation which many sellers will not do- that at least tells you that it was mailed to your zip code. Unfortunately, it appears to entirely be the fault of USPS In a case like this, I would not leave any feedback at all- the transaction was not completed due to outside influences.

 The seller did everything he needed to do and could confirm that it was mailed. I, in this case, would leave no feedback as well.

I have a problem with the seller not offering insurance. If it's optional, and he is mailing via USPS, why would he not offer it? I find that bothersome. If you want that option, great, pay for it... no skin off my back. But not to offer the option?
Personally, I don't offer the option when I sell, HOWEVER, I buy the insurance on my own to cover my own self. I charge a "handling" fee, which some disagree with for some reason I have yet to understand, but spend a part of that buying the insurance to cover both parties. I might be right, I might be wrong, but it seems to work for me.
I always buy insurance when it is offered, and think twice about bidding if it is not offered.
These are my opinions, yours may vary... Dave

The seller is required by the 30 day Mail Order Rule (FTC/Federal law) to get the item to the buyer. Period. Insurance protects the seller not the buyer. Some will argue that the listing and what it says is a contact. It does not trump federal law. The biggest lie on ebay? "I am not responsible for uninsured items."

That is my intent if I ever have to use insurance. The only negative I have ever given on ebay was against a seller that offered insurance as an option, and I paid it... Then the item arrived smashed. I found out from my post office that only the seller can redeem insurance. So I tried to get the seller to redeem and refund. He wouldn't return emails or phone calls. I was stuck with smashed glass, I paid for insurance, and ultimately got nothing for my money. I gave negative after waiting weeks for a reply to my emails and phone calls. I just know that if I ever have a problem with that seller, their disclaimer means nothing. No worries.

Good news! The 3 cent silver just showed up today, 17 days after "delivery was confirmed." The problem was that the shipping label was almost completely not readable - it had been washed out from moisture. I guess after I complained twice to the USPS, somebody at the post office finally figured it out & delivered it. So even though they showed that it had "been delivered" on Aug. 12, maybe they meant that it had been delivered to the local post office, as Steamwalker said above. How do you like that!
