There's no wear to the high points, it's just the strike. In hand when you tilt it, it really glistens. Here is my colourful one that NGC graded MS64, if you look at the crosses in the center, they are the highest points and aren't worn, same with the 1846. The 1859 below is quite a weak strike so a lot of people thought it was AU when I asked originally. If you look at the wings below on my 1859 you could easily be forgiven for thinking it was wear.
Personally I think the 1846 is MS63 with a shot at MS64. The obverse I've looked at under a loupe and I can't find any marks whatsoever, I think the obverse is actually MS66 or 67 but the reverse's light contact marks bring it down.
