That is a very nice coin that I would love to own. I have been aware of this die but have yet to see an example other than the BM example.
I suspect that this is an obverse legend angraver error rather than a deliberate CO II but more examples with different reverse types / dies may help through die analysis. I do have a reverse die match to a COS II die, which is why I make the statement of my suspicion above.
