That's an interesting definition of counterfeiting, but this is a ruling against ebay-dot-fr by a French court. It's done a bit differently in the US. After almost getting ripped off on a fake Tag Heuer watch, I simpy emailed Tag-Heuer's legal dept all the bogus auctions I could find...and they quickly vanished--no tribunal required.
